California’s Proposition 65 Listing of Glyphosate

On November, 15, 2017, NAWG joined a coalition of leading agriculture groups across the country as the lead plaintiff in a federal lawsuit against the State of California for its inaccurate classification of glyphosate under Prop 65. As a result of California’s Prop 65 listing, manufacturers of products containing glyphosate, or residues thereof, sold in California will need to affix a false and misleading warning label to their products.

On February 27, 2018, NAWG and plantiffs (collectively known as the Ag Defense Alliance) had a big win in the case. Citing harm to the nation’s agriculture economy, Judge William Shubb of the U.S. District Court for the Eastern District of California issued a preliminary injunction prohibiting California from implementing its “false and misleading” Prop 65 labeling requirement for the herbicide glyphosate.

On June 22, 2020, U.S. District Court Judge William Shubb for the Eastern District of California issued a ruling in favor of NAWG and the Coalition by granting summary judgment and issuing a permanent injunction enjoining the warning requirement of Proposition 65 as to glyphosate. Memorandum and Order Regarding Cross-Motions for Summary Judgment, June 22, 2020 (“June 22, 2020 Order”). NAWG and the Ag Defense Alliance have launched a website providing resources and information about its case against California’s unjustified Prop 65 listing of glyphosate. The Fix Prop 65 website provides research and background on the case, testimonials from farmers, information about glyphosate, how it is used, and what the scientific community has stated about this safe-for-use, environmental sustainable herbicide. For more information, visit  FIXPROP65.COM and read our release here.

NAWG Good Agricultural Practices (GAP) and Glyphosate brochure

Good agricultural practices (GAP) are specific methods which, when applied to agriculture, create food for consumers or further processing that is safe and wholesome. The United States Department of Agriculture (USDA) Agricultural Marketing Service currently operates an audit/certification program to verify that farms use good agricultural practice and/or good handling practice. This is a voluntary program typically utilized by growers and packers to satisfy contractual requirements with retail and food service buyers.

NAWG Farm Safety Brochure

Farm safety is recognizing the risks associated with the day to day work on a farm and implementing practices to reduce them. Despite the beautiful surroundings, agriculture is the on of the most dangerous industries in the nation. Each year thousands of farmers are injured, and hundreds die due to farm related accidents. Improving farm safety can reduce the number of accidents on the farm and even lead to savings for the grower.
